These terms and conditions apply to the purchase of goods at www.shop.simplychocolate.dk for delivery at www.shop.simplychocolate.dk. The right of withdrawal only applies to private consumers who shop via www.shop.simplychocolate.dk.
 
 

 

 

Payment and delivery

 

 

At www.shop.simplychocolate.dk we accept payment with:

We also accept the payment methods:
- MobilePay
The amount is only deducted when the item is dispatched. If you have ordered several items and one of the items is backordered, we will only deduct the payment for this item when the item is dispatched.
 
The prices are stated in Danish kroner and include Danish VAT. On top of the price, the price for shipping must be added. You choose the shipping method at the end of the ordering process. If necessary we bear payment fees.
 

 

 

 

 

 

Receipt for receipt of order and order confirmation
When you have ordered an item from us, you will receive a receipt (order confirmation) via e-mail confirming that we have received your order. A binding purchase agreement has been entered with us.
 

 

 

 

 

 

Shipping and delivery
We send all packages through our subcontractor Coolrunner, which enables you as a customer to choose between a number of different shipping companies.

If your order is below DKK 400, excluding shipping, you pay a shipping fee (the price appears when you choose the shipping option). The amount appears before placing your order. We deliver free of charge if you buy for more than DKK 400, excluding shipping costs, on one order.
 
The delivery time in Denmark is typically 1-3 working days.
 
 
EU + rest of the world 
There will be a shipping fee on all orders shipped out of DK. (the price appears when you choose the shipping option). The amount appears before placing your order.
The delivery time outside Denmark is typically 3-14 working days.
 
 
All our packages are insured and with a track & trace number. When your package has been sent, you will receive an email with tracking information that enables you to track your package.
 

 

 

 

 

 

Return and regret
You have the right to cancel your purchase without reason within 14 days. If you have purchased several items in one order, you can choose to cancel the purchase of some or all items. The cancellation period expires 14 days after the day on which you or another person chosen by you (but not the carrier) takes physical possession of the goods.

If you have ordered several items in one order and we cannot deliver the items at the same time, the cancellation period runs from when you or another person you have chosen (but not the carrier) takes physical possession of the last item. If the deadline expires on a public holiday, Saturday, Constitution Day, Christmas Eve or New Year's Eve, the deadline is extended to the following weekday.
 
 
How to use the right of cancellation:
You regret by notifying us that you regret, via e-mail: digital@simplychocolate.dk.

You cannot cancel by refusing to receive the item or by omit to pick it up without at the same time giving notice that you have cancelled. Danish customers can use the law's standard cancellation form, but it is not mandatory. You can find the form by clicking here: cancellation form

The cancellation period has been met if you send your notice that you regret the purchase before the cancellation period has expired.
 
 
Return of the item and return costs
If you have regretted the purchase of an item, you must send or deliver the item to us without undue delay and no later than 14 days after you have notified us that you wish to cancel your purchase. The deadline is met if you return the goods before the expiry of the 14 days.

In the return package, you must enclose a copy of the order confirmation, invoice or other documentation for your purchase.

Goods cannot be sent by cash on delivery or without delivery, and you must pay for the returning fee yourself. You should also ensure that the item is securely wrapped when you return it. You bear the risk for the package/goods yourself until we receive it. Therefore, keep the postal receipt as well as any track and trace number.
 
 
Refund of the money in case of cancellation
When you cancel, we will refund all payments received from you, including any delivery charges. However, this does not apply in the following cases:

If you have purchased several items in one order and regret only part of your purchase, we will not refund the delivery costs. If you have chosen a form of delivery that is more expensive than the cheapest form of delivery that we offer, you will not be reimbursed for the extra cost.

We will refund the amount without undue delay and in any case no later than 14 days from the date on which we received your notice of cancellation. However, we can withhold the refund until we have received the goods back or until you have sent documentation that the goods have been returned.

We will refund using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise. In any case, you will not be charged any fees as a result of the refund.
 
 
Testing of the product and packaging
You are only liable for a possible deterioration in the value of the goods, which is due to handling of the goods other than what is necessary to establish the nature, characteristics and the way in which the goods work.

You can normally examine the item in the same way as you can and are allowed to in a shop, but you must not use it. If you have used it in a way that you are not allowed or can in a business, and we cannot sell it again, or cannot sell it at full price again, you must count on us to deduct the decrease in value in the amount you are justified to get back. If the item no longer has a commercial value, we will not refund the purchase amount.

The item must be returned in intact original packaging. You should also ensure that the item is securely wrapped when you return it. You bear the risk for the package/goods yourself until we receive it. Therefore, save the postal receipt as well as any track and trace number.
 
Complaints - If there is something wrong with the item
As a consumer, you have a 24 months right of complaint. This means that if the item has a defect and you complain in time, you have the right to have the item repaired or exchanged in the first instance. If this cannot happen, or if it does not happen within a reasonable time, you can, depending on the circumstances, get the money back or a reduction in the price.

A defect is for example a manufacturing or material fault, or incorrect information about the product. On the other hand, normal wear and tear or damage you have caused to the product yourself is not a defect. If you discover a deficiency, you must notify us "within a reasonable time". We recommend that you make a complaint as soon as possible, especially if there is transport damage.

If you complain within 2 months of the defect being discovered, it is always within a reasonable time. If the complaint is justified, we will refund your reasonable and necessary shipping costs.

If you believe that the product has a defect, we ask you to provide as much detail as possible on what the problem is.

Remember the item always must be sent in proper packaging and receive a receipt for dispatch. Save postal receipt incl. information on shipping costs and any track and trace number.
 
 
Information on appeal possibilities
A complaint about a product or service can be submitted to the Center for Complaint Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to the Center for Complaint Resolution via The complaint portal for Nævnenes Hus.

The EU Commission's online complaints portal can also be used when submitting a complaint. It is particularly relevant for consumers with residence in another EU country. Below you will find the personal data we collect. We also describe the purpose of the collection and the legal basis for the processing.
When you visit www.shop.simplychocolate.dk, we automatically collect information about you and your use of the Website. We register e.g. which type of browser you use, which search terms you use, your IP address, including your network location and information about your computer.
The collection has no other purpose than to optimize the user experience and functions on www.shop.simplychocolate.dk, just as we use the information to target our marketing on various channels, for example Google Adwords. It helps us to offer our users the most relevant content. The legal basis for the processing is the EU Personal Data Regulation, art. 6, par. 1, letter f.
When you buy a product or communicate with us at www.shop.simplychocolate.dk, we collect the information you provide yourself. This can be name, address, e-mail address, telephone number, payment method, information about which products you buy and possibly have returned, delivery requests, as well as information about the IP address from which the order was made.
The purpose is to deliver the products you have ordered and otherwise fulfill our agreement with you, including to be able to manage your rights to return and advertise. We can also process information about your purchases to comply with legal requirements, including for bookkeeping and accounting. If you sign up for our newsletter, we collect information about your name, e-mail address and possibly mobile number. The purpose is to enable us to deliver newsletters to you. The legal basis for the processing is the EU Personal Data Regulation, art. 6, par. 1, letter f.
 
Recipients of Personal Information
Information about your name, address, e-mail, telephone number as well as order number and specific delivery wishes is passed on to the carrier responsible for the delivery of the purchased goods to you. When purchasing non-stock items, the mentioned information can be passed on to the manufacturer or seller of the item in question, who will then take care of the delivery.
Information can be left to external partners who process the information on our behalf. Collaborators may not use the information for any purpose other than fulfilling the agreement with us, and are subject to confidentiality regarding this.
 
Your rights
